No, these are special waivers granted by the Commission.
Latest rumor on FM translation of AM is that "The Kid" Kevin Martin is prepared to trade that away in order to allow more LPFM's on the air as part of the horse-trading to get modified ownership rules (specifically: increased radio-tv and newspaper crossownership).
If it does happen this way I can see a lawsuit. Granting special waivers for politically connected stations, then closing the door on anyone else gives the definite impression that the Commission operates strictly on a play-to-play basis.

If they walk on this I have a feeling Congress will get involved to make it happen. Congressmen have gotten involved the the first 4 stations in the country getting special permission. I can't see it stopping for the very reasons you mention. The people I see suing is the translator/religious groups that have clogged the system. Wait and see if the entire 2003 applications sent in from non comms are thrown out and dismissed to make room for LPFM and AM on FM translators. Those (if I am correct) companies will be the ones with a lot to lose to take it to court.
