The editor of the website putnamlive.com has been arrested.

Mark Hallburn was arrested on a trespassing-related charge, the Putnam County Sheriff's Department said. He was appearing before a Putnam County magistrate Tuesday afternoon.

The sheriff's department said Hallburn had been contacting the health department and had filed some Freedom of Information requests. He was sent an email from the health department indicating that he could meet with the administrator between certain hours, but he showed up the health department outside of those hours, the sheriff's department said.

The editor of the website PutnamLive.com has been arrested.

Mark Hallburn was charged with willful disruption of governmental process, according to a criminal complaint filed in Putnam County Magistrate Court.

The complaint said a Putnam County sheriff’s deputy responded Tuesday to Teays Corp. Center in Scott Depot to investigate a trespassing complaint. He said when he arrived, he met Hallburn in the lobby of the Putnam County Health Department. Hallburn told the deputy he was supposed to have a meeting with Joel McKinney about a Freedom of Information request, and McKinney would not talk to him, the complaint said.

The deputy said he spoke with health department workers, and they said Hallburn came in and asked to speak to McKinney. The complaint said McKinney heard Hallburn talking and causing a disturbance. He told Hallburn what he needed to do to get the information he wanted, but that did not satisfy Hallburn, the complaint said. The complaint said Hallburn’s actions caused other workers to stop working to see what was going on, made it difficult for them to wait on other people and made it difficult for computer maintenance work to be completed.

Hallburn was charged after the deputy said he determined that he did cause a disturbance and interrupted the health department office.

Meanwhile, Hallburn told Eyewitness News that he arrived at the building for his scheduled appointment for a Freedom of Information request to examine the department’s financial documents. He said he had reports the department is about to be evicted for nonpayment of rent and that it spent more than $100,000 in legal fees to fight the reinstatement of a former employee. He said a grievance board ruled that the department wrongfully terminated the employee twice.

“This is a classic example of prior restraint of the press, and a violation of the First Amendment,” Hallburn said. “We have a report they have been audited by the state of West Virginia for their financial situation. I look forward to my day in court.”

The Putnam County Health Department could not be immediately reached for comment on Hallburn’s statements.
